NRI in Net: Beginning of 2nd Round
It was kind of routine day for us though despite being Best Criminal Advocates in Delhi, we were slightly frustrated thinking it was not moving in a direction, we reached court where the criminal cases (Section 12 of The Protection of Women from Domestic Violence Act, 2005 and 498A IPC) for Ms. Fxxxxxx were listed on our call we appeared before the court and started apprising of the latest developments.
In came a person with covered face and said I am Mxxxxxxx pleading I had no idea of these cases against me as due to Covid19 situation I was not able to travel back to India etc. etc….. with him were the other co-accused (mother and brother), only father of Mr. Mxxxxxxx was missing from picture now
Court asked the counsel if you are representing Mr. Mxxxxxxx for which he had no clue as Mr. counsel had already mentioned no whereabouts of Mr. Mxxxxxxx during the hearings including co-accused who gave affidavit as to having no idea of Mr. Mxxxxxxx, anyhow court gave time to Mr. Mxxxxxxx and his counsel to come back with Vakalatnama and other documents clarifying their stand in two hours, they left the court preparing for the same.
We reached back to our research desk and started making points so as we do not miss this opportunity of welcoming Mr. Mxxxxxxx in Indian jail, on time we reached back before the Hon’ble court and waited for the submissions of accused party who pretended to be innocent and ignorant of the fact that there are cases against Mr. Mxxxxxxx, he sought sympathy of the court and mentioned that he will be present before the court on all the dates henceforth and should be given bail this time, we waited patiently and asked for our chance to make submissions.
At our turn, we said Mr. Mxxxxxxx has five cases against him with 83 dates, 14 warrants/ summons, 2 state police searching from him and reports mentioning he doesn’t stay at the address and there is an international search opened in his name at this we forwarded order copy of Hon’ble family court and said due to this pressure only Mr. Mxxxxxxx has come to surrender and now seeking sympathy of court as if he is not aware of cases against him, he wants to take the Hon’ble court for a ride for another 5 years, if he is given bail now he will never return, rounds of arguments went on, one after another, we pushed various citations seeing if it is swinging away from us finally no resort, court ordered judicial custody for Mr. Mxxxxxxx, it was respite for the family who struggled for years, after Mr. Mxxxxxxx was taken into custody we moved application of notice in case there is a bail application from their side to which Hon’ble court graciously accepted.
This happened on 2nd July 2022 and since then several rounds of settlement talks have taken place but Ms. Fxxxxxx wants to teach Mr. Mxxxxxxx a lesson as to she has suffered a lot during these years and she seems to be in no mood for a peace treaty as of now she is exercising all options at our office being Divorce Law Firms in Delhi
