Trouble shared is trouble halved

A tedious task we took up in last few months for a lady who struggled for five from years pillar to post, Ms. Fxxxxxxx married to Mr. Mxxxxxxx in the year 2016, right after the marriage, family of boy started harassing girl saying that her father didn’t gave sufficient dowry including a demand of car from boy’s family which surfaced after marriage

Torture to the girl rose to level where she told her father couple of times it is becoming difficult to deal now, being father he consoled the daughter and asked her to adjust with in laws hoping it will settle soon, also he gave another round of gifts to her in laws

During this period girl became pregnant, but the torture on her didn’t stop even then, nor boy or his family gave a pity to the girl’s condition rather their attitude towards her was going bad to worse, it reached to level where she couldn’t bear it any more she called her father crying and said it is no more a tolerable situation and she was told by her father to leave her husband’s house immediately and brought her back to his own house after a period of only four months of marriage, to their surprise no one from her in laws turned up for two months to discuss or to take the girl back to her marital home

Since it wasn’t going anywhere, she decided to pursue a legal action against her husband and his family for what all they did to her, meanwhile she was blessed with a baby boy, to her utter shock now also no one from boy’s family turned even at this stage

She registered an FIR in local police station in year 2017 for domestic violence, case was registered in court summonses were issued to boy and his family but no one showed up in court, from common friends and relatives Ms. Fxxxxxxx got to know that the boy fled overseas right after she left for her father’s house this was a big shock to her, she was told he visits India regularly and stays at his house, surprisingly none of the warrant has been serviced

During the progress of the case, Honourable court issued warrants in the name of Mr. Mxxxxxxx which remained un-serviced and every time report was coming Mr. Mxxxxxxx is not staying at the given address, though the family members of the boy out of pressure joined the investigation and were released on bail

Almost three years passed opposite members who remained absent from court proceedings were Exparte and an amount of maintenance was decided in Ms. Fxxxxxx’s favour but it was still directionless case

We rushed back to research desk picked up our material, printed couple of citations on the relevant sections and re-drafted the applications, at 11.55 we reached back court with bare acts, citations and changed application

Hon’ble court recorded the submissions and citations, we also handed over the bare acts to court staff, Hon’ble court got convinced, and asked us to furnish an affidavit by 2 Pm, we reached back court with the affidavit, Hon’ble court said, everything is in order we will pass order by 4 Pm, we requested for Dasti order and Hon’ble court graciously accepted the same

Holding our breath, we along with client anxiously waited until 4 Pm and by 4.15 we had the order to restrain travel of Mr. Mxxxxxxx with direction to all the organisations looking at this, father of Ms. Fxxxxxxx couldn’t control his emotions and said we were directionless for five years with no clue on how to move forward, with the restraining orders we went to organisations offices in Delhi and Embassy of XXXXXX, in next two days we received the confirmation, that name of Mr. Mxxxxxxx and passport number is system revoked, meaning he will be apprehended when attempt to leave India, client got a big relief

Now, we are entering second phase of all the cases of Ms. Fxxxxxxx one of which will be divorce as being one of the best Divorce Law Firms in Delhi having top rated Divorce lawyers in Delhi NCR, an effort will be made to nab Mr. Mxxxxxxx through local police and if he attempts to flee country this time he will be apprehended at the airport
